PUBLIC CONTRACT FOR RENDERING OF SERVICES

This Public Contract (hereinafter referred to as the “Contract”) stipulates the procedures for rendering services in statistical analysis of tennis matches, as well as mutual rights, obligations and relationship between Individual Entrepreneur Mikhail Haurylchyk acting under certificate of registration #9512596058 (NIP) dated 13 May 2024, hereinafter referred to as the “Contractor”, and customer of services, hereinafter referred to as the “Customer” having accepted public offer of this Contract.

1. TERMS AND DEFINITIONS

Statistical analysis – standard pdf-file containing numeric data, diagrams and tables acquired by the Contractor using dedicated software.

Tennis match profile – names of players, tournament title, date of match and other information used for match identification.

2. SUBJECT OF THE CONTRACT

2.1 The Contractor provides services in statistical analysis of tennis matches, and the Customer pays for services rendered pursuant to the terms and procedures set forth in this Contract.

2.2 For the purpose of this Contract, the Customer can buy services for aggregate statistical analysis, video clips editing and other services.

3. PROCEDURE FOR CONCLUDING CONTRACT

3.1 This Contract constitute the Public Contract, whereby the Contractor assumes liability for rendering services in statistical analysis of tennis matches with respect to every Customer application.

3.2 Posting of this Contract on the Contractor’s official website public-offer is considered as public offer made by the Contractor, whereby the Contactor shall conclude the Contract with any Customer who agrees to enter into the Contract.

3.3 The Customer shall accept all terms, exemptions and exceptions of this Contract.

3.4 This Contract is considered to be concluded upon receipt of the application via e-mail info@tenniscomstat.com or through feedback.

3.5 Provided that acceptance is completed in accordance with the established order, this Contract is considered to be concluded in simple written form.

3.6 Place of the Contractor is considered to be the place of conclusion of the present Contract.

4. RIGHTS AND OBLIGATIONS OF THE PARTIES

4.1 The Contractor is obliged to render services in statistical analysis of tennis matches (hereinafter – Services).

4.2 The Contractor is obliged to render full Services of the required quality subject to the terms and conditions of this Contract.

4.3 The Contractor shall render Services at the time specified in Para 6.3 of the present Contract.

4.4 The Contractor reserves the right to make amendments in this Public Contract, therefore, the Customer shall read and understand the current Contract and other information before receiving Services.

4.5 The Customer shall provide to the Contractor video record of the match required for rendering Services, except as otherwise provided herein.

4.6 The Customer is obliged to pay Services rendered in due time and in a manner stipulated by this Contract. After Services are paid, all payment records shall be saved (you will receive notifications via e-mail specified in application).

4.7 During rendering of Services, the Parties shall take into consideration mutual proposals with respect to the present Contract.

5. COST OF SERVICES AND PAYMENT PROCEDURE

5.1 Cost of rendered Services shall be determined by the Contractor and brought to the notice of the Customer before Service ordering.

5.2 Payment shall be made within twenty-four hours of rendering a Service through Stripe e-payment system or via direct bank remittance as per invoice sent by the Contractor via e-mail.

5.3 Bank card payments are effected through Stripe e-payment system. Payment page meet all data communications security requirements (PCI DSS Level). All confidential data is held in encrypted form and tamper-proof.

5.4 We accept cards of international payment systems VISA and MasterCard. You can also pay via PayPal, Apple Pay and Samsung Pay.

6. REFUND POLICY

6.1 Settlements with the consumer upon the return of the paid commodity monetary amount are carried out in the same form in which the payment for the Services was made unless otherwise stated. The refund procedure is governed by international payment systems.

6.2 To return funds to a bank payment card, you must fill in the “Application for the return of funds” and send it to the e-mail address info@tenniscomstat.com.

6.3 Refunds will be made to a bank payment card within 7 (seven) business days from the date of receiving the “Application for the return of funds”. The refund amount will be equal to the purchase amount.

6.4 To return funds on transactions made with errors, you must apply with a written application and attachment of checks / receipts confirming the incorrect debiting. This application must be sent to the email address info@tenniscomstat.com.

7. TRANSFER AND ACCEPTANCE OF SERVICES

7.1 The Contractor shall begin rendering Services upon receipt of the application with complete match profile from the Customer via e-mail info@tenniscomstat.com.

7.2 The Customer shall provide video record of the match by posting URL-links, copying to the Contractor’s server, hard media transfer (face-to-face) or by any other means specified in application.

7.3 The Contractor shall send to the Customer pdf-file containing statistical report within twenty-four hours after application receipt via e-mail it was previously sent from.

7.4 Act of rendered Services shall not be provided.

7.5 In terms of this Contract, rendering of Services by the Contractor is confirmed by sending to the Customer statistical report on tennis match with reference to the application previously received from the Customer.

8. LIABILITY OF THE PARTIES

8.1 In case of default of performance of obligations under this Contract, the Customer and the Contractor bear liability under the existing laws of Georgia.

8.2 Repayment of money is not provided.

8.3 In case of impossibility of performance risen through the Customer’s fault, then rendered Services shall be fully paid.

8.4 In case when non-performance occurred as a result of force majeure circumstances, the Customer shall pay Services rendered, and the Contractor shall provide results of Services done.

8.5 In the event of the Customer’s refusal to perform under this Contract, the Customer covers expenses incurred by the Contractor, and the Contractor provides overall results.

9. DURATION AND ALTERATION OF CONTRACT

9.1 This Contract shall come into force when accepted by the Customer and remains in force until Services are fully rendered.
