TERMS OF SERVICE
1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the Tennis ComStat platform, services, and any related products or communications (collectively, the “Services”) provided under the brand Tennis ComStat.
By accessing, registering for, or using the Services in any manner, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.
Tennis ComStat provides professional video-based tennis match analytics and performance tools to teams, players, coaches, and organizations. These Terms apply to all users of the Services, including but not limited to customers under signed service agreements, account holders, and individuals accessing the platform via third-party integrations.
These Terms may be used in conjunction with specific Service Proposals or commercial agreements. In case of any conflict between these Terms and a separately signed Master Service Agreement (MSA), the terms of the MSA shall prevail.
Tennis ComStat is a product and brand operated by Individual Entrepreneur Mikhail Haurylchyk, based in Warsaw, Poland. All references to "Tennis ComStat", "we", "our", or "us" in these Terms refer to this legal entity.
2. Definitions
For the purposes of these Terms, the following terms are defined as follows:
“Match Video” (or “Match Footage”): A video recording of a tennis match provided by the user, either directly or via integrated third-party platforms (such as Track Tennis). Match Videos are the basis for video tagging and statistical analysis.
“Match Description”: All non-statistical information related to a match, including player names, score, scoring format (e.g., AD or no-AD), tournament name, stage, and appearance details. Accurate Match Descriptions are essential for correct analysis.
“Tennis ComStat Platform” (or “Platform”): The web-based software environment where users access video analytics, statistical dashboards, reports, and tagged match content.
“Video Analysis Services”: The process of analyzing tennis match footage using a combination of AI-based tracking and manual tagging to generate performance insights. This includes tagging shot types, directions, outcomes, and player movement.
“Deliverables”: The output provided through the Platform, which may include tagged video, dashboards, downloadable reports (PDF), and raw statistical data (CSV).
“Subscription” or “Match Package”: A time-limited or usage-limited plan that grants access to the Platform and associated services, as described in a Service Proposal or pricing agreement.
“Client” or “User”: Any individual or organization accessing the Services, including players, coaches, staff, and representatives of teams or institutions.
“Confidential Information”: Non-public business, technical, or personal information shared between the user and Tennis ComStat, including but not limited to match content, player data, account details, and internal communications.
3. Scope of Services
3.1 Overview
Tennis ComStat provides video-based match analytics for tennis teams, players, and coaches. Using a combination of AI-powered computer vision and manual tagging by trained analysts, our services deliver detailed breakdowns of match performance and player behavior.
3.2 Platform Access
The Tennis ComStat Platform allows users to:
- Upload or submit match footage for analysis
- Access player-specific and team-wide dashboards
- View and filter tagged match video
- Download PDF reports and raw data in CSV format
- Track performance trends over time
Account access is provided upon submission of a match or by request from an authorized team representative. Additional access for players, coaches, or staff may be granted upon request and approval.
3.3 Match Packages and Subscriptions
Access to the Platform and Services is provided through paid subscriptions or match-based packages, which may be:
- Time-bound (e.g., tied to a specific season or term)
- Usage-bound (e.g., limited by number of matches)
Details of each plan or package are outlined in individual Service Proposals or listed on our pricing materials.
Unused matches from one season or package do not carry over to future periods unless explicitly agreed in writing.
3.4 Timelines
We aim to complete video analysis within 24 hours of receiving a valid Match Video and Match Description. Processing times may be delayed in case of incomplete, inaccurate, or low-quality submissions.
4. Match Submission
4.1 Supported Submission Methods
You may submit Match Videos for analysis using one of the following methods:
- Track Tennis Integration
If your matches are recorded via Track Tennis, you can submit them directly through an integrated request form available in the Track Tennis system. This allows for fast and seamless video transfer to the Tennis ComStat Platform. - Direct Link Submission
If your match is hosted on a third-party platform (e.g., YouTube, Vimeo, Google Drive), you may submit the video by sending a link (URL) via:- Email to info@tenniscomstat.com, or
- Our support chat or WhatsApp channel (for existing clients)
4.2 Match Description and Requirements
Each submission must include a Match Description, containing at minimum:
- Player names
- Score or outcome
- Scoring format (e.g., AD or no-AD, standard sets, short sets)
- Tournament name and round (if applicable)
- Player appearance/clothing details (for identification)
Incomplete or inaccurate match information may delay processing or result in incorrect analysis.
4.3 Video Quality Standards
We reserve the right to reject any submitted video that does not meet minimum quality standards (e.g., obstructed view, poor resolution, missing parts of the court).
If a video is rejected, we will notify you and may request a replacement.
4.4 Responsibility for Content
You are responsible for ensuring that you have the right to upload and analyze the submitted Match Videos. This includes obtaining any necessary consents from individuals appearing in the footage, as required by applicable privacy or media laws.
5. Deliverables
Upon completion of video analysis, Tennis ComStat provides users with access to a set of structured deliverables through the Platform. These include:
5.1 Tagged Match Video
Every analyzed match is processed into timestamped video clips linked to specific events — such as rallies, serve types, winners, and errors — allowing users to efficiently review and filter points by tactical criteria.
5.2 Player and Team Dashboards
Interactive dashboards summarize performance metrics for each player, including:
- Serve and return patterns
- Shot direction and depth
- Rally length and shot combinations
- Error breakdowns (e.g., forced vs. unforced)
- Positional tendencies and movement
Dashboards can include both player-specific and team-wide views.
5.3 Reports and Data Exports
For each analyzed match, users may download:
- PDF Match Reports — Summarized visuals and tables for coaches and players
- CSV Files — Raw, structured data suitable for custom analysis or external tools
5.4 Access Method
All deliverables are made available on a self-service basis via the Tennis ComStat Platform. Notifications may be sent by email or chat once the analysis is complete. Platform access requires an active subscription or valid match package.
6. Use of Data and Content
6.1 Ownership and Licensing
All proprietary technology, tools, methods, and processes used to deliver Tennis ComStat Services remain the sole property of Tennis ComStat.
Users retain ownership of the original Match Videos they submit but grant Tennis ComStat a limited license to use, process, and analyze the footage as necessary to provide the Services.
6.2 Use of Data for Product Improvement
Tennis ComStat reserves the right to use anonymized or aggregated data generated through analysis — including positional data, statistical outputs, and tagged events — for purposes such as:
- Machine learning and AI model training
- Research and development
- Quality control and product improvement
If a user wishes to opt out of such data reuse, they must contact us directly in writing.
6.3 Privacy and Consent
By submitting Match Videos, you confirm that:
- You have the legal right to share and process the video for analysis
- All individuals shown in the video (e.g., players, coaches, officials) have been informed or have given consent where legally required
- The video does not violate the rights of third parties, including copyright, publicity, or privacy rights
Tennis ComStat assumes no responsibility for footage submitted without appropriate permissions.
6.4 Content Monitoring and Removal
We reserve the right to refuse, suspend, or remove any content that:
- Violates applicable laws or third-party rights
- Is submitted in a manner that misrepresents the match or players
- Interferes with the integrity or security of the Platform
This includes but is not limited to Match Videos, metadata, or submitted match descriptions.
8. Platform Access and Termination
8.1 Account Access
An account is automatically created for the user who submits the first match for analysis (typically the head coach or team representative). Additional user accounts (e.g., for assistant coaches, players, or staff) may be created upon request and approval.
You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account. Please notify us immediately of any unauthorized access or suspected security breach.
8.2 Service Period and Expiration
Access to the Tennis ComStat Platform is linked to an active subscription or valid match package. When a package expires (e.g., at the end of a season), access to new match processing may be suspended, but existing data may remain available (see below).
We do not offer automatic renewals unless specified in writing. Users must purchase new packages to continue service beyond the current term.
8.3 Termination by User
You may choose to stop using the Services at any time. No refunds will be provided for early cancellation or unused matches unless otherwise agreed.
8.4 Termination by Tennis ComStat
We may suspend or terminate your access to the Platform without notice if:
- You violate these Terms or applicable laws
- Your payment is significantly overdue
- Continued use poses a risk to the integrity or security of the Platform
8.5 Post-Termination Access
After cancellation or expiration, your account may retain read-only access to analyzed matches for 90 days, during which you can download:
- Tagged videos
- Match reports (PDF)
- Raw data (CSV)
After this period, access will be disabled. Data may be retained on our systems unless you request its deletion or applicable laws require removal.
9. Third-Party Services
9.1 Track Tennis Integration
Tennis ComStat integrates with Track Tennis, a third-party live streaming and recording platform. If your matches are hosted on Track Tennis, you can submit them directly for analysis via an embedded request form in their system.
Track Tennis is an independent service and is not operated or controlled by Tennis ComStat. We do not guarantee the availability, quality, or technical performance of any matches recorded by Track Tennis.
9.2 Use of Third-Party Services
Tennis ComStat relies on third-party services for video hosting, payment processing, and communication. We are not responsible for any failures, delays, or disputes arising from the use or unavailability of these services.
Users are responsible for ensuring that any third-party-hosted content or payments are properly configured and accessible.
10. Security and Confidentiality
10.1 Data Security
Tennis ComStat applies industry-standard security measures to protect the confidentiality and integrity of your data, including:
- Password-protected accounts
- Encrypted access to the Platform
- Role-based access controls for user accounts
While we take reasonable steps to safeguard data, no system can guarantee absolute security. Users are responsible for protecting their account credentials and reporting any suspected breaches.
10.2 Confidential Information
Any non-public business, technical, or match-related information exchanged between you and Tennis ComStat will be treated as confidential.
Each party agrees to:
- Use such information solely for the purpose of providing or receiving the Services
- Not disclose it to third parties without written consent, unless required by law
- Take reasonable measures to protect it from unauthorized use or disclosure
These confidentiality obligations remain in effect for five (5) years after the end of the service relationship.
11. Limitations of Liability
To the fullest extent permitted by law, Tennis ComStat’s total liability for any claims arising out of or relating to the Services shall be limited to the total fees paid by you during the twelve (12) months preceding the claim.
Tennis ComStat shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Service delays or unavailability due to external factors or force majeure events
12. Indemnification
You agree to take full responsibility for any issues that result from:
- How you use the Services
- Breaking these Terms
- Uploading videos or content without proper rights or permissions
- Violating someone else’s privacy, copyright, or other legal rights
If any of these lead to a legal claim or dispute, you agree to cover any costs, losses, or legal fees that Tennis ComStat may face as a result.
This obligation continues even after you stop using the Services.
13. Governing Law and Dispute Resolution
These Terms are governed by and interpreted under the laws of Poland, without regard to conflict of law rules.
If a dispute arises, both you and Tennis ComStat agree to try to resolve it informally and in good faith. If no resolution is reached, the dispute will be handled by the courts of Warsaw, Poland, which will have exclusive jurisdiction.
14. Changes to Terms
Tennis ComStat may update these Terms from time to time. If we make material changes, we will notify you by email (if applicable) or by posting a notice on the Platform.
By continuing to use the Services after the changes take effect, you agree to the updated Terms. If you do not agree, you should stop using the Services.
